Written by A delegation from Chinese State Intellectual Property Office (“SIPO”) recently visited Brazil’s Intellectual Property Office (Instituto Nacional da Propriedade Industrial, “INPI”).
On 13 November 2017, the INPI and the SIPO signed an agreement that provides for, among other things, staff training, dissemination of IP in society and joint cooperation.
Importantly, a patent prosecution highway (“PPH”) project was agreed upon. The agreed PPH provides for patents applications that had been previously examined by one of the parties to be given priority (fast-tracking) in the other.
During the preparation for the PPH, up to 200 patent applications will be analysed. From the Brazilian end, fast-tracking will be provided to applications relating to information technology, packaging, measuring and chemistry. At the SIPO end, there will be no restriction as to the types of applications that will be fast-tracked.
The PPH will come into force in February 2018, when more detailed rules will be published.
